Is it legal

According to the bill, also known as the Agricultural Improvement Act of 2018, "all derivatives, isomers and cannabinoids in hemp are legal, provided the end products contain less than 0.3% Delta 9 THC."

This was further updated in summer 2020 with new rules. The first point of this update is as follows: “It's changing 21 CFR 1308.11(d) (31) by adding language to say that the definition of "tetrahydrocannabinols" does not include "material, compound, mixture or preparation" falling under the conditions set out in 7 U.S.C. 1639o. "

Again, the language does not fully legalize Delta 8, but solidifies the fact that substances obtained from legal industrial hemp are not classified as "THC" under US law.

When it comes to the online cannabis industry, a gray area is all but legal, and when consumer demand started to show up, retailers quickly jumped in. Currently, Delta-8 is ILLEGAL (with specific laws) in the following states: Alaska, Arizona, Arkansas, Delaware, Idaho, Iowa, Mississippi, Montana, and Nebraska.
