Major hurdle passed in California Psychedelics Legalization Bill


In a big leap for the psychedelic industry, a second California Senate committee recently passed a bill to legalize the possession of many different forms of psychotropic drugs in the Golden State.

The legislation, sponsored by Senator Scott Wiener (D), was passed by the Public Safety Committee earlier this month, and by the Health Committee a week later. If this law is fully passed, an extensive list of psychedelics, including psilocybin mushrooms, DMT, ibogaine, LSD, and MDMA, will be legalized for adults 21 and older.

“The war on drugs has been a pathetic failure because it is based on the false belief and misconception that criminalizing, arresting, imprisoning people for possession and drug use will somehow deter consumption and improve public safety,” he commented before voting. “It didn’t do either.”

“Instead, over the past half century we’ve spent trillions on the war on drugs, more people are using drugs now, there is more addiction, there are more overdoses – I’m talking about drugs in general, not psychedelics. And we’ve blown tax dollars and we need to move to a more health-centric approach, ”he added.

Under the law, the state Department of Health would need to set up a task force to investigate possible regulatory systems and make recommendations that California could put in place to promote safe and equitable access to certain substances in permitted legal contexts. These recommendations would be due by January 1, 2024.

In addition, the bill would require the overturning of previous convictions for possession of psychedelics, just as the state seeks to overturn convictions for cannabis. as well as the redefinition of the utensils that are permitted to possess and use with these newly legalized substances.

The bill bans the use of peyote, an endangered plant, to ensure availability for traditional Native American spiritual practices, according to the Multidisciplinary Association for Psychedelic Studies (MAPS), a global organization for psychedelic research and education.

Numerous cities, states, and regions in the United States have already eased restrictions on the therapeutic use of psychedelic mushrooms, including all of Oregon and New Jersey, Denver CO, Oakland CA, and Washington DC
