Over the past few weeks, Congress has been trying again and again to iron out the framework of a 5,593-page COVID-19 relief bill, the longest bill ever written in US history and buried deep in its text, like the vaping industry we know them, change them.

The main problem with this COVID bill, aside from the weird spending points, is that it is being used as a front for passing laws unrelated to the virus. At the top of our list is a note on page 5.136 United States Postal Service (USPS) ban on shipping vaping products to adult consumers. The PACT law

The PACT Act, which is part of the Jenkins Act, redefines the word “cigarette” to include all “electronic nicotine delivery systems”. Despite the word “nicotine” used in the bill, the overall definition is so broad that the legislature has marked ALL vaping liquids, including those containing CBD and standalone devices for vaping THC and other cannabinoids, in red.

These changes to the invoice will take effect in 120 days. From this point on, all orders for vaping products must be shipped via an alternative service. This can be extremely costly and requires the signature or a recipient who is 21 years of age or older.

Starting 90 days after this new law goes into effect, all internet and mail order companies will be required to submit monthly length reports to states, indigenous tribes, and local governments that include identity, location, and product orders from all customers who purchase vaping items under their jurisdiction.

The title of the original Congressional bill that contained this text was Act Preventing Children From Selling E-Cigarettes Online. However, it is already illegal under federal law to ship vaping and tobacco products to minors, and this new version of the mandate also applies to adults in legal markets.

Increased risk of COVID

Logical critics argue that this new law, hidden in the text of a COVID relief bill, may ironically increase the risk of someone being exposed to and developing the disease. Take an older woman who recently switched from cigarettes to vape products to improve her health. She lives alone in a rural area and has products shipped to her to reduce the risk of developing COVID. The new law would force this hypothetical elderly woman out of her home into the general public to look for vape products, increasing her chances of exposure to not only COVID-19 but other diseases like the flu.

“The sponsors of this legislation have repeatedly refused to consider common sense changes that would have protected the youth while not unnecessarily closing down small businesses,” said Gregory Conley, president of the American Vaping Association. “Thanks to their intransigence, the language in the omnibus is so sloppily worded that the USPS also allows the shipment of CBD liquids intended for vaporizing, as well as devices intended for use with THC or other non-nicotine substances, forbids. “

He added: “There are still 36 million American adults who smoke flammable cigarettes, and over 400,000 will die from smoking-related diseases this year alone. The American people should wonder why their government wants to make it difficult for adults to quit smoking. “

There was a lot of back and forth on this bill, but the main source of disagreement was the size of the stimulus tests, but there was no doubt that this vaping bill was going to get under the radar. Ultimately, the bill was passed as expected. Legislators trusted that most people wouldn’t look up and read the ridiculously long bill themselves, and they were right.

Now we have 120 days before the industry as we know it changes for the worst – LEGAL customers will no longer be able to purchase vaping products by mail order thanks to this new bill.

Experts believe that larger, better capitalized companies can easily bear the cost of complying with the new regulations, while smaller companies, the mom-and-pop stores, will eventually end up being pushed out of the market.
